How Is Whiplash Compensation Calculated?

Two Compensation Figures

The total compensation amount that you are offered will be calculated by adding together two figures - an amount for general damages and an amount for special damages.

1. General Damages

The figure you receive for general damages is related to your injury itself. The severity of your whiplash and the long-term implications the whiplash will have upon your life will be taken into account when calculating this figure. At the most basic level, the more serious your whiplash injury and the longer it is estimated that you will take to recover, the bigger the amount of financial compensation you will receive will be.

To properly assess your injuries your solicitor will ensure you have a thorough medical examination, will look at medical records and all other relevant evidence. When your lawyer has a substantial enough amount of information about your injury they will calculate the figure you should receive by looking at the extent of your injury and looking at compensation amounts that individuals with a similar whiplash injury received in past settlements.

2. Special Damages

The second part of financial compensation you will receive is a figure that reimburses you for any other monetary losses you have incurred as direct result of your whiplash injury. This includes things such as loss of earnings, cost of travel to and from appointments, cost of painkillers and other prescriptions and the cost of treatments such as physiotherapy sessions. Your lawyer will look at receipts, pay slips and so on to calculate a fair figure for special damages compensation. The aim of whiplash injury compensation is to try and put you back in position you were in prior to the accident that you were a victim of and part of this is to ensure that you are back in the same financial position as before.
