Making A Personal Injury Claim

Making a personal injury claim shouldn't be intimidating and it isn't complicated. If you have been injured by the negligent actions of a third party you deserve to be compensated for the pain and suffering you have been through. To make a personal injury claim in these circumstances all you need to do is to decide to exercise your legal right to compensation.

You are likely to be eligible to receive personal injury compensation if you have been involved in an accident which -

1. Was not your fault

2. Was caused by the error of a third party or

3. Was caused by the fault of something else (e.g. a product)

The first step towards making a successful compensation claim is to find out whether you have viable grounds to make a claim. Many solicitors will offer you a free consultation so you can discuss the circumstances of your injury with them. A specialist personal injury lawyer will be able to tell you whether it is worth progressing a personal injury claim within a matter of minutes.

If it is confirmed that you could make a potentially successful compensation claim you will need to instruct a lawyer. You do not necessarily need to continue your case with the lawyer who gave you initial legal advice. Find a personal injury lawyer who is suited to you and your case. Talk to a few lawyers, get a few quotes and do your research. You want an experienced lawyer who offers a payment scheme that works for you and has good testimonials in the area of personal injury law that your claim will come under. If your case is successful your legal fees are likely to be covered by the defendant.

Once you have instructed a solicitor they will guide you through the claims process every step of the way. All that you will need to do is provide your lawyer with the information they need to substantiate your claim as and when they ask for it. For this reason it is advisable to keep records of all information which may serve to support your claim in court from the time of the accident onwards. Keep a record of your injuries and how they progress. Also keep a record of any financial losses that you have incurred as a direct result of your injury - e.g. prescription costs and travel to and from appointments.
