Making A Work Accident Claim

Having an accident in the workplace is not only painful, but can lose you earnings for the time you take of work and in some circumstances may mean you cannot return to work. Therefore, if you have had an accident at work you may be considering making an accident at work claim.

The first thing that is necessary for you to be able to make an accident at work claim is that you are not self-employed. If you are self-employed you cannot make a claim for compensation for an injury, however you may have to report some accidents to the health and safety executive so ensure that this is done if needed. However, if you are an employee of a firm, your employer is responsible for your safety in the work place. If you have had an accident at work that has occurred as a result of their health and safety negligence, you are likely to be eligible to make a work accident claim. Consult with a lawyer to find out whether you have viable grounds to claim.

If you think you might be eligible, or are eligible, to make an accident at work claim you should then ensure that your accident is on record and that you are happy with the way it has been recorded. Your workplace should have an accident book and your accident should be noted in this. Only sign an entry in the accident book if you think it is an accurate depiction of what happened. Your lawyer will refer to this record as evidence so it must be correct. You should also ensure that you make a trip to your doctor or to an A&E department for treatment so your injuries are on your medical record.

When you have ensured your accident is recorded accurately you should find yourself a lawyer to instruct. You should choose a lawyer who specialises in work accident claims cases. At the same time, keep a record of the progression of your injuries and of any financial losses you have incurred as a direct result of the accident. Financial losses may be things such as prescription costs or physiotherapy bills.

Once you have instructed a lawyer they will guide you through every step of the claims process. Making a work accident claim will not be difficult, you will simply need to provide evidence and information to help substantiate your claim as and when your lawyer asks you for it. This is why it is advisable to keep records so you can easily provide them to your lawyer when they are needed.
