Personal Injury Compensation - What Can I Claim For?

'Personal injury' is a broad term to say the very least, and it covers a range of injuries obtained in a range of ways. At the most basic level, you can only make a claim for personal injury compensation if you have obtained an injury which can be proven to be a direct result of the negligent actions of a third party. If you have simply had an accident for which no one is to blame, you will not be able to make a claim for compensation.

Types of Personal Injury Compensation

There are many different types of personal injury compensation and you should speak to a specialist solicitor directly to properly ascertain whether you can claim for your injury. However, here a few categories of personal injury claim.

  • Accident at work: Your employer has a legal duty to ensure, to the best of their ability, that you are safe in your place of work. Therefore, if you have had an accident at work, and it is found that your employer was not adhering to health and safety law correctly, you will have viable grounds to claim for compensation for your injury.
  • Work related disease: Everyone needs to be able to work for a living, and if you have contracted a preventable disease due to your occupation, you should be compensated for this. Some common work related illness claims include asbestos related disease, repetitive strain injuries and industrial asthma.   • Accidents involving vehicles: motorbikes, cars, HGVs, bicycles, buses. Vehicles can be very dangerous and if you are involved in an accident which was not your fault you can claim compensation for your injuries.
  • Trip, slip or fall: If you have a trip, slip or fall in a public place you may be able to gain compensation for your injury from the company that owns the property e.g. bar or restaurant, or from the council.
  • Holiday illness or accident: having an accident or falling ill on holiday is awful and completely ruins what was meant to be a relaxing break. It is possible to make a claim against a company which caused you trouble whilst abroad.
  • Product liability claims: there is a lot of litigation in place to ensure that consumers are safe when they buy products on the UK market. If a faulty product causes injury it is possible to be compensated for this injury.

What Does My Compensation Cover?

Simply put, your personal injury compensation will include: a compensation sum calculated in view of the extent of your injury, compensation for loss of earnings, compensation for expenses incurred due to the injury e.g. modifications to home, reimbursement of treatment/prescription costs and reimbursement of travel costs.
