Product Liability Claims

All businesses that provide products to consumers are legally required to ensure that they are safe for the public to use. If they are unsafe and cause injury or harm a business will face legal action. This can result in them being fined or even being send to prison. If a faulty product has injured you you may be able to make a claim for financial compensation for your injuries from the negligent company.

  • Manufacturers
  • Importers
  • Wholesalers
  • Shops

The amount of responsibility that each of these parties have differs. Producers have the largest amount of responsibility - in the eyes of the law - to ensure that products are safe. However, even if a company is not manufacturing a product they must be aware of their responsibilities, including a responsibility to not sell any products that are found to be unsafe.

Producers and manufacturers must ensure that products are safe, where necessary they have the appropriate warnings featured on them, must provide information to consumers about safe use of the product and must take appropriate action should a fault be found with the product.

What Do I Do If A Product Injures Me?

If a faulty product injures you, you have the right to sue. You can sue the producer of a product that has injured you even if you did not purchase the product yourself. In most circumstances you will have 3 years from the date of the injury, and in some special cases you may even be able to claim up to 10 years from the date of the injury. You should do the following if a faulty product has injured you: -

  • Get medical treatment: Your health is your first priority and you should get to a doctor to ensure you are given the correct treatment to get back to full health.
  • Contact a personal injury lawyer: the quicker you contact a specialist lawyer, the better your chance of success. This is because your injuries will be at their most prominent in the time immediately following the accident and you will be able to explain the circumstances of your injury in the most detail.
  • Keep records: keep a record of your physical and psychological injuries. This is not vital but it will substantiate the evidence that will be used in court to support your claim. Also keep a record of any financial losses that you have suffered as a direct result of your injuries – e.g. loss of earnings.
